Terms Of Use

1. Welcome

These Terms of Use ("Terms") are an agreement between you and Anatol Labs, a French simplified joint-stock company (société par actions simplifiée) registered under SIREN 106 027 956, with its registered office at 1 rue des Fauvettes, 34990 Juvignac, France ("Anatol Labs", "we", "us"), operator of the Matchamind mobile app for iOS and Android (the "App"). By downloading, opening, or using the App — as a guest or with an account — you agree to these Terms. If you don't agree, please don't use the App.

2. What Matchamind is

Matcha Mind is a daily emotional well-being app that helps people build a healthier inner dialogue. Inspired by Cognitive Behavioral Therapy (CBT) and mindfulness practices, it combines mindful micro-journaling, emotion labeling, and AI-powered affirmations personalized from each user's own reflections to help reframe limiting thought patterns and develop a more balanced perspective. The app also offers a library of affirmations, guided practices, ambient sounds, mood tracking, monthly AI insights, and gentle reminders to support lasting emotional growth and self-awareness.

3. Well-being only

Matcha Mind is an emotional well-being and self-reflection app designed to help users build a healthier inner dialogue. It is not a medical device and does not provide medical, psychological, or psychiatric advice, diagnosis, treatment, or crisis intervention. Nothing in the app is intended to replace professional healthcare or mental health services.

The app's content is inspired by published psychological research and Cognitive Behavioral Therapy (CBT) principles, but the app itself has not been clinically tested or validated, and its content is not created, reviewed, or supervised by a licensed psychologist or mental health professional. Affirmations and exercises are general in nature and are not a form of therapy or personalized clinical guidance.

If you are experiencing a mental health crisis or believe you may harm yourself or others, seek immediate help from your local emergency services or a qualified mental health professional. In the United States, call or text 988 (Suicide & Crisis Lifeline). In the European Union, call 112. Elsewhere, contact your local emergency number or an appropriate crisis support service. This information is also available within the app, including during onboarding and in Settings.

4. Who can use it

You must be at least 18 years old to use the App. By using it, you confirm that you meet this age requirement.

5. Accounts and guest use

You can use Matchamind as a guest (no account), or create an optional account with email/password or Google/Apple sign-in. If you have an account, you're responsible for keeping your login secure. Tell us at admin@matcha-mind.com about any unauthorized use.

6. Deleting your account and data

You can delete your data at any time.

• Account holders (in the App): open Settings → Delete Account and confirm. This permanently deletes your personal data — mood entries, notes, generated affirmations, and profile — within 30 days.
• Guests (in the App): open Settings → Wipe my data and confirm. This erases all data stored on your device and cancels scheduled reminders. Guest data lives only on your device, so there is nothing on our servers to retain.
• By email (either): write to admin@matcha-mind.com from the address on your account (or, for Google/Apple sign-in, tell us which you used). We verify each request and complete deletion within 30 days. This mailbox is monitored.

What we keep, and why. After deletion we retain limited records where the law requires: subscription and transaction records for up to 10 years (accounting and tax), and analytics only in anonymized or aggregated form, for up to 24 months. These are not used to identify you — see the Privacy Policy (Section 18).

Deletion does not cancel your subscription. Cancel it separately in your App Store or Google Play account (Section 7) to stop future charges. Deletion is irreversible.

7. Subscriptions and payments

Some premium content requires an auto-renewing subscription, purchased and billed through the App Store or Google Play and managed in your store account.

• Auto-renewal: it renews for the same period and price unless you cancel at least 24 hours before the current period ends; the store charges within 24 hours before renewal. Length, price, and terms are shown at purchase.
• Cancel: iOS → Settings → [your name] → Subscriptions; Android → Google Play → Payments & subscriptions → Subscriptions. Cancellation cannot be done inside the App.
• Refunds: requested through and processed by the App Store or Google Play under their terms. This does not limit any non-waivable statutory refund or consumer rights (Section 16).
• EU/EEA/UK: you normally have a 14-day right of withdrawal for digital content; by starting to access premium content immediately you request immediate supply and acknowledge you lose that right once access begins. Your other statutory rights are unaffected.

8. Your content

Your notes and mood entries are yours. To provide the service, you grant us a limited licence to store and process them — including sending your notes to our third-party AI provider(s) to identify emotions and generate affirmations. We use this only to operate the features you use.

9. How affirmations and emotional insights work

Matchamind uses AI in two ways: to identify emotions from what you write, and to generate personalized affirmations and insights based on that reading.

Emotion identification is inferred by AI from your text. It is not a clinical assessment, and the AI may misread, oversimplify, or misidentify what you are actually feeling.

Affirmations and insights are intentionally generated to gently reframe what you share toward a more balanced or constructive perspective, rather than simply validating or agreeing with everything you write. However, this does not mean the result is always accurate, appropriate to your situation, or therapeutically sound: reframing is a general technique, not a personalized clinical judgment, and it is not professional advice.

Do not rely on it for health or safety decisions. If any content feels wrong or distressing, disregard it and, if you need support, speak with a qualified professional or a crisis line (Section 3).

10. Acceptable use

Use Matchamind lawfully. Don't misuse, disrupt, gain unauthorized access to, reverse-engineer, or copy the App, or use it for any unlawful purpose.

If you do we may suspend or terminate your access to the App, with or without prior notice depending on the severity of the breach. This does not affect any subscription cancellation rights under Section 7, nor your right to request deletion of your data under Section 6.

Where required by law, we may also share relevant information with competent authorities in cases of illegal activity.

This is without prejudice to any other remedy available to us.

11. Intellectual property

The App and its content — design, text, sounds, illustrations, and software, but not your own notes and mood entries — belong to Anatol Labs or its licensors. You get a personal, non-transferable right to use the App under these Terms.

12. Apple App Store terms

If you downloaded the App from the Apple App Store, this agreement is between you and Anatol Labs only, not Apple. Apple has no obligation to provide maintenance or support for the App. Apple is not responsible for any product warranties, claims, or your use of the App, and is a third-party beneficiary of these Terms with the right to enforce them.

13. Disclaimers and limitation of liability

The App is provided "as is" and "as available", without warranties of any kind. To the fullest extent permitted by law, Anatol Labs is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the subscription fees attributable to your purchases via the App Store or Google Play in the 12 months before the claim. Some laws do not allow certain limitations, so some may not apply to you.

14. Force Majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including outages of third-party service providers (including our AI provider), internet or telecommunications failures.

15. Changes to these Terms

We may update these Terms. When we do, we will change the date above and, where appropriate, notify you in the App. Continuing to use Matchamind means you accept the updated Terms.

16. Governing law

These Terms are governed by French law, without affecting mandatory consumer-protection rights you may have where you live (for example, under EU law).

17. Jurisdiction and dispute resolution

Any dispute not resolved amicably shall be submitted to the competent French courts, without prejudice to any mandatory consumer protection rules applicable in your country of residence.

19. Entire agreement and severability

These Terms and our Privacy Policy constitute the entire agreement between you and Anatol Labs regarding the App. If any provision is found invalid or unenforceable, the remaining provisions remain in full force.
